The following Terms of Service ("Terms") are a legally binding agreement that governs your use of the services offered by Talk to Star through our application, website, and related services (collectively, the "Services"). Please review these Terms carefully. By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you should not access or use our Services.
All content present within the Talk to Star app, including but not limited to graphics, logos, text, images, audio clips, data compilations, and software, is the exclusive property of Talk to Star or its content suppliers, and is protected by international copyright laws. The compilation of all content within the Talk to Star app is also the exclusive property of Talk to Star and protected by international copyright laws.
Furthermore, all software used in the provision of the Services is the property of Talk to Star or its software suppliers and is protected by international copyright laws.
The trademarks, logos, service marks, and trade names (collectively the "Trademarks") displayed on the app or on content available through the app are registered and unregistered Trademarks of Talk to Star and others and may not be used in connection with products and/or services that are not related to, associated with, or sponsored by their rights holders that are likely to cause customer confusion, or in any manner that disparages or discredits their rights holders.
All Trademarks not owned by us that appear on the app or on or through the app's services, if any, are the property of their respective owners. Nothing contained on the app grants by implication, waiver, estoppel, or otherwise, any license or right to use any Trademark displayed on the app without the written permission of Talk to Star or the third party that may own the applicable Trademark.
Your misuse of the Intellectual Property displayed on the Talk to Star app is strictly prohibited.
Under no circumstances will Talk to Star be held responsible for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use of the application, regardless of the nature of the claim or the form of action, whether in contract, tort, or otherwise. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if Talk to Star has been advised of the possibility of such damages.
The Services and all information, content, materials, products, and other services included on or otherwise made available to you through the Services are provided by Talk to Star on an "as is" and "as available" basis, unless otherwise specified in writing.
Talk to Star makes no representations or warranties of any kind, expressed or implied, as to the operation of the Services, or the information, content, materials, products, or other services included on or otherwise made available to you through the Services, unless otherwise specified in writing.
You expressly agree that your use of the Services is at your sole risk. It should be noted that the Services do not replace professional astrological advice or any other professional advice. The Services should be used for entertainment purposes only. You should not make any major life decisions based solely on the information provided by the Services. Any actions taken as a result of the Services provided by Talk to Star are done entirely at your own risk.
Talk to Star holds the authority to revise these terms at any given moment without advance notice. You carry the responsibility of consistently reviewing these terms for modifications. Your sustained use of Talk to Star's Contents and Services following the enforcement of changes is deemed as an acceptance of the updated terms.
You agree to indemnify, defend, and hold harmless Talk to Star, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the Service from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service using your device.
This indemnification obligation will survive the termination of these Terms and your use of the Talk to Star app. You also agree to indemnify Talk to Star for any legal fees or other costs incurred by Talk to Star arising out of any breach of the warranty and representation made by you herein or for any claim brought by a third party against Talk to Star due to your actions or omissions.
